{"id":588,"date":"2017-05-12T13:42:36","date_gmt":"2017-05-12T13:42:36","guid":{"rendered":"http:\/\/minddigital.net\/step\/?p=588"},"modified":"2025-07-02T15:35:04","modified_gmt":"2025-07-02T15:35:04","slug":"different-scotland-divorce-effect-wills","status":"publish","type":"post","link":"https:\/\/advisingfamilies.org\/uk\/information-portal\/family-matters\/different-scotland-divorce-effect-wills\/","title":{"rendered":"Divorce and the effect on wills in Scotland"},"content":{"rendered":"<p>Finalising a divorce is a vital time to bring your personal affairs up to date \u2013 particularly your will, power of attorney and potentially your title deeds.<\/p>\n<p>Many people assume that divorce will automatically invalidate a will, power of attorney or <span class=\"tooltips \" style=\"\" title=\"In Scots Law, a Survivorship Destination or Survivorship Clause is a legal clause by which one spouse or civil partner can leave their whole interest in the property to the surviving spouse or civil partner\">Survivorship Destination<\/span>, but that is only part of the story.<\/p>\n<p>Although the law has tried to accommodate the likelihood that people will not wish their ex-spouse or civil partner to benefit from their estate, the legal treatment of existing arrangements can potentially give rise to a further set of complications, which can easily be avoided by carrying out a review with a <a href=\"http:\/\/www.step.org\/advising-families\/find-a-tep\" target=\"_blank\" rel=\"noopener noreferrer\">qualified advisor<\/a>.<\/p>\n<h2>Changes to Scots Law<\/h2>\n<p>Under Scots Law prior to November 2016, a divorce had no impact on a will, but recognition of the change in families and relationships has resulted in recent changes to modernise Scots Law and bring it more in line with other parts of the UK. Now, like the rest of the UK, an ex-spouse or civil partner is treated as though they have died before the granter of the will.
