Why marriage revokes a will"},"content":{"rendered":"\n<p>If you\u2019re preparing for your wedding or registering your civil partnership, then congratulations!&nbsp;<\/p>\n\n\n\n<p>Almost certainly the last thing on your mind, as you\u2019re discussing menu plans, flowers, etc. is your will or testament. But the succession rules of England and Wales may surprise you. Getting married or registering a civil partnership revokes any prior will you may have.<\/p>\n\n\n<p>There is an exception to this rule. You can do your will in advance, and state that the will is \u2018in contemplation\u2019 of the <span class=\"tooltips \" style=\"\" title=\"This article uses the term marriage to refer both to marriages and to registrations of civil partnerships, just for ease of reading&lt;i&gt;.&lt;\/i&gt;\">marriage\/civil partnership<\/span>. Then your will remains valid, even if the marriage doesn&#8217;t actually take place<em>.<\/em><\/p>\n\n\n<p>Alternatively, you can specify that your will is \u2018conditional upon\u2019 your marriage happening, which might be handy if you want to cater for the possibility of someone getting cold feet and calling the whole thing off. After all, you might not want your will to pass assets to your intended, if they\u2019ve just jilted you at the altar!<\/p>\n\n\n\n<p><strong>Does it matter if my will is revoked?<\/strong><\/p>\n\n\n<p>If your marriage has just revoked your will, it means the intestacy laws apply if you were to die.\u00a0 These may not be in line with your wishes.<\/p>\n<p><!-- \/wp:post-content --><\/p>\n<p>Under these laws, if you have no children, then your new spouse is entitled to everything you own.<\/p>\n<p><span style=\"font-size: revert;color: initial\">If you have children, your spouse will get all of your assets worth up to \u00a3322,000. If your estate is worth more than \u00a3322,000, it will be divided between your spouse and your children:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none\">\n<ul>\n<li>Your spouse gets all your personal belongings, \u00a3322,000 in assets and half the rest<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none\">\n<ul>\n<li>Your children get the other half share above \u00a3322,000. If any of your children have died before you, their children will inherit in their place.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><\/p>\n<p><span style=\"font-size: revert;color: initial\">An important note: The intestacy rules only recognise biological or adopted children. That means step-children and foster children don\u2019t inherit.<\/span><\/p>\n<p><strong style=\"font-size: revert;color: initial\">Capacity and \u2018predatory marriage\u2019<\/strong><\/p>\n<p><span style=\"font-size: revert;color: initial\">Automatic revocation of a will upon marriage is becoming contentious. There are numerous examples of elderly people who sadly no longer have capacity to make a new will.\u00a0<\/span><\/p>\n<p><span style=\"font-size: revert;color: initial\">But many people aren\u2019t aware that there are different levels of legal capacity, depending on what you\u2019re doing. So, the \u2018amount\u2019 of capacity needed to get married is lower than the level of capacity needed to give instructions for a new will.<\/span><\/p>\n<p><span style=\"font-size: revert;color: initial\">This means someone may have sufficient capacity to marry, which automatically revokes their will, but insufficient capacity to do a new will afterwards.<\/span><\/p>\n<p><span style=\"font-size: revert;color: initial\">If you\u2019re one of the beneficiaries of that old will, which was automatically revoked, you may not be too happy to learn the new spouse will inherit (perhaps everything) under the intestacy rules.<\/span><\/p>\n<p><span style=\"font-size: revert;color: initial\">Concerns about \u2018predatory marriages\u2019, where elderly or vulnerable people are persuaded to marry someone they\u2019ve only recently met (for example a carer or neighbour) are increasing. This is putting the automatic revocation of wills on marriage under the spotlight.\u00a0<\/span><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>After all, there\u2019s an argument that if someone doesn\u2019t have capacity to make a new will, they equally don\u2019t have capacity to revoke their existing will.
